My workers are self-employed or work through their own companies and they sort out their own tax so I am in the clear, right?

Not necessarily. Employment status is a matter of fact based on the nature of a role rather than a matter of choice. Recent changes to legislation will make it easier for HMRC to identify cases where employment status is an issue and this is an area in which increased focus can be expected. And remember, in cases where it is found that an employer should have operated PAYE but didn’t, the employer will be responsible for all the tax and NI that ought to have been deducted but wasn’t – even if the worker has already paid their own tax and NI!
